Denver Apartment Renovations Near Broncos Stadium Released Asbestos During Multiple Playoff Games
The United States Attorney’s Office filed criminal charges in the United States District Court in Denver, CO against Willmax Capital Management Inc., the company that owns an apartment complex close to the Denver Broncos’ stadium, as well as John “Tom” Williams, the company’s director, for allegedly releasing asbestos into the air during two playoff games during the 2014 season on Wednesday, November 16. Charging documents stated that:
“John Tom Williams negligently released asbestos into the ambient air and at the time thereby negligently placed other persons in imminent danger of death or serious bodily injury…and John Tom Williams aided, abetted, commanded, procured and willfully caused the same."
According to Williams’ lawyer, the asbestos release was caused when subcontractors were sanding the floors Towers 3 and 8 of the Overlook at Mile High Apartments, located at 3190 W. 14th Ave. in Denver, CO. Online promotional materials for the apartments indicate that they are “within walking distance” of Sports Authority Field at Mile High Stadium, the home of the Broncos.
Well over 100,000 people attended the two games in question – more than 77,000 fans attended the January 19 AFC Championship Game against the New England Patriots alone.
While court documents indicate that Williams has not been arrested, his attorney has said that his client and Willmax Capital Management Inc. have entered a plea agreement with the United States Justice Department and the Environmental Protection Agency (EPA) in order to resolve the criminal case. Williams’ attorney also indicated that his client has agreed to plead guilty to a misdemeanor charge during his hearing on December 14.
According to the charging documents, Willmax Capital Management Inc. violated Titles 40 and 42 of the United States Code of Federal Regulations through their actions. Williams faces as much as a $100,000 fine and one year in jail, and Willmax Capital Management Inc. faces at least $500,000 in fines.
