BCH Advocates for Texan Man Injured in Vaping Device Explosion

Bailey Cowan Heckaman PLLC has filed a personal injury lawsuit on behalf of a Texan gentleman who suffered injuries due to a device explosion and fire.

The lawsuit was brought against Texas Vape Stores LLC in the 45th District Court of Bexar County, Texas, and centers on allegations of defective design, failure to warn, and negligence.

According to the complaint, the Plaintiff was handling the SMOK X-Priv vaping device at his residence when the device unexpectedly exploded, causing a fire that resulted in severe second-degree burns to his hand, palm, and fingers.

Promptly after the incident, the Plaintiff was transported to a nearby hospital in New Braunfels, Texas, and later transferred via ambulance to a medical center in San Antonio, Texas, for comprehensive evaluation and treatment.

The SMOK X-Priv vaping device is manufactured by Shenzhen Ivps Technology Co., Ltd., located in Shenzhen, China. The lawsuit contends that Defendant Texas Vape Stores LLC is responsible for marketing, distributing, and selling the SMOK X-Priv, which is allegedly unreasonably dangerous. Additionally, the Defendant is accused of negligence for failing to warn of potential dangers or risks of harm and not providing sufficient instructions for the safe use of the product, which are claimed to be the direct cause of the incident in question.

The lawsuit seeks both compensatory and punitive damages, with the Plaintiff seeking an amount of $250,000 or less for the injuries sustained. The Plaintiff, along with their legal representation, has requested a jury trial for this case.
