Bailey Cowan Heckaman is pleased to announce that Partner Robert Cowan has been selected to the Plaintiffs’ Steering Committee for the 3M earplug coordinated litigation. Robert was appointed by U.S. District Judge Margaret Catharine “Casey” Rodgers on October 6th in In re: 3M Combat Arms Earplug Products Liability Litigation, Case No. 3:19md2885.
Robert’s appointment speaks to his and BCH’s record of success in handling mass torts, as well as to the very recent trial victory in the 3M earplugs multidistrict litigation (“MDL”). On October 1, 2021, BCH, its co-counsel, and 3M MDL plaintiffs’ leadership secured an $8.2 million dollar jury verdict in favor of U.S. Army veteran Brandon Adkins, who now suffers from lifelong tinnitus and hearing loss caused by defective 3M military-issue earplugs. The litigation over 3M’s earplugs has grown into the largest MDL in history. There are now more than 250,000 claims pending in Pensacola, Florida federal court before Judge Rodgers, and hundreds more in state court in Minnesota, where 3M is headquartered.
