Who Can Be Held Liable for a Rideshare Accident?

Texas is an at-fault insurance state, meaning that an injured party can hold the person or party that caused the accident liable for their damages. If an Uber or Lyft driver was responsible for the accident that caused your injuries, they may be held liable for any accident-related losses.

What makes rideshare accidents unique is the insurance policy that may apply. Different insurance policies take effect depending on which “period” of driving the rideshare driver was in when the accident occurred. Liability can be complex in any accident, which is why it is critical to consult with an attorney as early as possible.

What Insurance Coverage Applies If I Am Injured in a Rideshare Accident?

Texas requires rideshare drivers that drive with a transportation network company (TNC) like Uber or Lyft to carry a higher amount of insurance. The increased amount kicks in when the driver is using the rideshare app. The applicable insurance coverage depends on the “period” that the driver is in.

The periods for rideshare drivers and minimum insurance requirements are:

  • Period 0 - The driver is using their vehicle for personal purposes and the rideshare app is off. Texas requires minimum insurance of $30,000 for bodily injury liability coverage per person, $60,000 for bodily injury per accident, and $25,000 for property damage per accident.
  • Period 1 - The driver has the rideshare app turned on and is waiting for a ride request. Texas requires minimum insurance of $50,000 per person for bodily injury, $100,000 for bodily injury per accident, and $25,000 per accident for property damage. Both Uber and Lyft maintain third-party liability insurance if a driver’s personal insurance does not apply.
  • Period 2 - The driver is en route to pick up a passenger or has passengers in their vehicle. Uber and Lyft maintain at least $1,000,000 for third-party auto liability as well as some other coverage depending on the company.

Whether you were a passenger, driver, or another motorist injured in a rideshare accident, you might be entitled to these higher insurance amounts. It is essential to discuss your case with an attorney who can help determine all of your legal options.

Can I Sue Uber or Lyft If I Am Involved in a Rideshare Accident?

In most rideshare accident cases, you submit a claim to the applicable insurance policy. Generally, you do not sue the rideshare company directly, but there are exceptions. If you are involved in an Uber or Lyft accident, you need to consult with a lawyer. A lawyer will walk you through the legal process including determining how to obtain compensation for your injuries.

How Much Will I Receive If I Am Injured in an Uber or Lyft Accident?

The amount of money you will receive if you are injured in a rideshare accident will depend on several factors including the severity of your injuries, who was at fault, and which insurance policy applies.
