Attorney Cowan Featured on NBC 5 News
Attorney Cowan was recently featured on NBC 5 News as a source familiar with the 3M military earplugs lawsuits. As noted in the article, Cowan is a court-appointed attorney with Bailey Cowan Heckaman, who is overseeing litigation related to 3M earplug lawsuits nationwide. As of now, an astounding 290,000 active service members and veterans have filed claims against the earplug manufacturer, claiming that the product contained a dangerous defect.
Many service members allege that they suffered severe hearing loss, tinnitus, and other hearing-related issues after wearing the combat earplugs. According to complaints filed against the manufacturer, the earplugs were defectively designed. The design was too short, preventing a snug, protective fit in the ear canal. The earplugs subject to claims were used between 2003 and 2015 in combat or military training exercises.
Currently, 3M has paid millions to individuals who have taken their cases to trial. According to NBC News, the earplug manufacturer had paid out a total of $220 million to compensate victims for their losses. Attorneys with BCH Law filed a personal injury lawsuit on behalf of an Iraq War veteran who suffered hearing loss and tinnitus connected to the alleged defective design of the 3M combat earplugs.
Previously, the Minnesota-based company agreed to pay $9.1 million to resolve allegations that it “knowingly sold” defective earplugs to the United States military. The settlement resolved allegations that the manufacturer violated the False Claims Act by selling the defective product to the Defense Logistics Agency.

Philips CPAP Litigation
Several models of Philips CPAP (Continuous Positive Airway Pressure) machines were recalled after reports that the polyester-based polyurethane (PE-PUR) sound abatement foam used in its devices was prone to degradation resulting in life-threatening, permanent injuries to users. The foam would break down into potentially toxic particles that could be inhaled or ingested.
Millions of CPAP and BiPAP machines, as well as several ventilator models, were affected by the recall. All devices were manufactured prior to April 26, 2021. If you currently have or previously used a recalled CPAP machine, you need to contact a drug and medical device injury lawyer to discuss a potential legal claim.
It is alleged that Philips knew that their product was defective six years before issuing a recall. On March 10, 2022, the FDA issued a notification order which determined that the recalled products present “an unreasonable risk of substantial harm to the public health.”
Status of CPAP Claims in the United States
An MDL was formed in the Western District of Pennsylvania. The Honorable Joy Flowers Conti is presiding over the MDL and has appointed a 12-member plaintiffs’ steering committee in addition to lead counsel. In total, there have been 24,000 causes tolled. There are 102 class actions and 162 personal injury claims regarding Philips CPAP devices.
Individuals with qualifying injuries and proof of exposure are encouraged to contact our office immediately. Qualifying injuries may include but are not limited to kidney, liver, or lung disease, respiratory failure, cancer, pleural effusion, and chemical poisoning.
Pfizer Xeljanz Litigation
Between 2012 and 2018, Pfizer’s Xeljanz was approved by the FDA for the treatment of Rheumatoid arthritis, Psoriatic arthritis, and ulcerative colitis. In 2019, concerns over an increased risk of pulmonary embolism and death resulted in a safety communication being released by the FDA.
Shortly after the release of the safety communication, Pfizer was required to put a black box warning label on the drug, and its use was limited to the treatment of ulcerative colitis in adults. A subsequent black box warning was mandated after initial trial results showed Xeljanz users had an increased risk of serious heart-related problems and cancer.
Status of Xeljanz Claims in the U.S.
Currently, an MDL has not been formed for Xeljanz litigation. However, clients who have taken Xeljanz or Xeljanz XR for the treatment of arthritis for a minimum of six months are encouraged to contact our office.
To qualify, Xeljanz users must have taken a 10 mg dose twice per day and must have suffered a pulmonary embolism, deep vein thrombosis (DVT), stroke, or other blood clot-related injury while taking the drug. It is not known how many individuals were affected by this potentially dangerous drug.

Fatal Onewheel Nosedive Accident Claims Life of Young Father
A fatal Onewheel nosedive accident has claimed the life of a young father in Gypsum, Colorado. According to a complaint filed by Bailey Cowan Heckaman on behalf of the victim’s estate and his family, Mr. Bunnell was riding a Onewheel on December 2, 2021, when the device suddenly shut off, causing the front of the board to dip abruptly.
The unexpected nosedive violently ejected Mr. Bunnell from the electric skateboard onto the pavement knocking him unconscious. The impact, witnessed by Mr. Bunnell’s young son, caused severe head and brain trauma. Paramedics were called to the scene, where Mr. Bunnell temporarily regained consciousness before returning to his residence.
Once home, his condition deteriorated quickly, resulting in his transport to a local hospital before having to be airlifted to a trauma center in Denver, Colorado. Despite lifesaving efforts and emergency surgery, Mr. Bunnell succumbed to his injuries related to the Onewheel accident.
Onewheel Nosedive Accident Representation
Mr. Bunnell is not the first Onewheel accident victim. Tragically several other individuals have been seriously injured while riding the device. Partner Robert Cowan Appointed to 3M Earplug MDL Plaintiffs’ Steering Committee
Bailey Cowan Heckaman is pleased to announce that Partner Robert Cowan has been selected to the Plaintiffs’ Steering Committee for the 3M earplug coordinated litigation. Robert was appointed by U.S. District Judge Margaret Catharine “Casey” Rodgers on October 6th in In re: 3M Combat Arms Earplug Products Liability Litigation, Case No. 3:19md2885.
Robert’s appointment speaks to his and BCH’s record of success in handling mass torts, as well as to the very recent trial victory in the 3M earplugs multidistrict litigation (“MDL”). On October 1, 2021, BCH, its co-counsel, and 3M MDL plaintiffs’ leadership secured an $8.2 million dollar jury verdict in favor of U.S. Army veteran Brandon Adkins, who now suffers from lifelong tinnitus and hearing loss caused by defective 3M military-issue earplugs. The litigation over 3M’s earplugs has grown into the largest MDL in history. There are now more than 250,000 claims pending in Pensacola, Florida federal court before Judge Rodgers, and hundreds more in state court in Minnesota, where 3M is headquartered.

The verdict, awarded by a federal jury in Florida on Friday, October 1, 2021, is the latest successful test trial in mass tort litigation over 3M’s CAEv2 earplugs. In April, 3M was ordered to pay over $7 million in damages to three veterans who suffered injuries as a result of the defective earplugs. In June, 3M was ordered to pay $1.7 million to another U.S. Army veteran.

BCH Advocates for Texan Man Injured in Vaping Device Explosion
Bailey Cowan Heckaman PLLC has filed a personal injury lawsuit against Texas Vapes Stores, LLC on behalf of an injured Texas man whose vaping device exploded causing him second-degree burns.
Per the complaint, Plaintiff was handling the SMOK X-Priv vaping device in his home when the device suddenly exploded, and fire erupted from the device. While the device was on fire, it stuck to Plaintiff's hand resulting in serious second-degree burns to the hand, palm, and fingers.
Plaintiff was immediately driven to a nearby hospital.
